About These Terms

These Terms & Conditions ("Terms") govern your use of the services provided by Elevate Tht Ltd, trading as KYMA28, including all classes, class packs, and any other services booked through the KYMA28 mobile application or directly with the studio.

By creating an account on KYMA28 or purchasing any service from KYMA28, you confirm that you have read, understood, and agreed to these Terms in full. If you do not agree with any part of these Terms, you should not use our services.

These Terms are governed by the laws of the Republic of Cyprus and comply with applicable European Union consumer protection regulations.

Eligibility

To use the services of KYMA28, you must:

• Be at least 18 years of age
• Have completed the health questionnaire on the KYMA28 app prior to booking your first class
• Have agreed to these Terms & Conditions at the point of account creation

By proceeding with any booking, you confirm that you meet these requirements.

Booking & Classes

All classes at KYMA28 must be booked in advance through the KYMA28 mobile application. Walk-in bookings are not guaranteed and are subject to availability.

Class Format

• All Reformer and Tower classes are conducted in small groups of maximum 3 clients per session
• Private sessions are one-on-one with your instructor
• Each session format and duration is described within the KYMA28 app at the time of booking

Punctuality

We ask that all clients arrive on time and ready to begin their session. Out of respect for your instructor and fellow clients, please ensure you are present at the start of your scheduled class time.

Cancellation Policy

We understand that plans can change. Our cancellation policy is designed to be fair to all clients and to allow us to offer available spots to others in a timely manner.

Early Cancellation

• Cancellations made more than 3 hours before the scheduled class start time will receive their credit back in full
• Cancellations can be made directly through the KYMA28 app

Late Cancellation

• Cancellations made less than 3 hours before the scheduled class start time are considered late cancellations
• The class credit will be forfeited and will not be reinstated

No-Show

• Failure to attend a booked class without prior cancellation constitutes a no-show
• The class credit will be forfeited and will not be reinstated

The cancellation deadline and remaining time are clearly displayed within the KYMA28 app at the time of booking and in your upcoming bookings view.

Waitlist Policy

When a class is fully booked, clients may join the waitlist through the KYMA28 app. The following conditions apply:

• If a spot becomes available, waitlisted clients are added to the class automatically in order of their position on the waitlist
• You will receive an SMS notification as soon as you are booked into the class
• Once automatically booked, the standard 3-hour cancellation policy applies
• If you are automatically booked and fail to cancel within the 3-hour window, or do not attend, the class credit will be forfeited as per the standard cancellation and no-show policy

It is your responsibility to ensure your notification settings are active so you receive waitlist alerts in a timely manner. KYMA28 cannot be held responsible for missed notifications resulting from device or notification settings.

Class Packs & Expiry

KYMA28 offers class packs that allow you to purchase multiple credits at a discounted rate. The following terms apply to all class packs:

Expiry

• All credits expire on the date stated at the time of purchase
• Unused credits are forfeited upon expiry and cannot be used to book classes after the expiration date
• Expired credits are non-refundable and cannot be extended, transferred, or exchanged, except at the sole discretion of the studio in exceptional circumstances (see Section 14)

Transferability

• Class credits are personal and non-transferable to another person
• Credits may only be used by the account holder who purchased them

Intro Offer

KYMA28 offers a complimentary first class to new clients as an introductory offer. The following conditions apply:

• The intro offer is available to new clients only — one per person, non-repeatable
• The complimentary class has no monetary value and cannot be exchanged for cash or credit
• The intro offer is non-refundable and non-transferable
• The standard cancellation and no-show policy applies — failure to cancel at least 3 hours in advance or failure to attend will result in the complimentary class being forfeited
• The intro offer is redeemable through the KYMA28 app and is subject to class availability

KYMA28 reserves the right to withdraw or modify the intro offer at any time without prior notice.

Payments & Refunds

Payment

• All payments are processed in Euro (€)
• Payments are handled securely through Stripe. By completing a purchase, you agree to Stripe's terms of service
• Full payment is required at the time of purchase before any class credits are issued

Refunds

• Class packs are refundable for unused credits only, at any time before the pack's expiry date
• To request a refund, contact the studio in person or by email at maria@kyma28.com
• Refunds are calculated based on the number of unused credits remaining at the time of the request, at the per-class rate of the pack purchased
• Credits already used to book classes — including credits forfeited due to late cancellation or no-show — are not eligible for refund
• The intro offer is non-refundable under any circumstances

Processing Time

Approved refunds will be returned to the original payment method within 5–10 business days, subject to your bank or card provider's processing times.

Health & Medical

Your safety is our highest priority. Before you can book your first class, you are required to complete a health questionnaire within the KYMA28 mobile app. This questionnaire must be completed honestly and in full.

• You confirm that all information provided in the health questionnaire is accurate and complete at the time of submission
• You agree to notify the studio immediately if your health status changes in any way that may affect your ability to participate safely in classes
• If you are currently under medical treatment, recovering from injury or surgery, or have any condition that may be affected by physical exercise, you must obtain written clearance from your doctor before attending any class at KYMA28
• KYMA28 reserves the right to request medical documentation at any time before permitting a client to participate

Participation in any class is at your own risk. By attending, you confirm that you are in a suitable physical condition to do so.

Liability Waiver

By creating an account on KYMA28 and attending classes at KYMA28, you acknowledge and agree to the following:

• Reformer Pilates and physical exercise involve an inherent risk of injury. You voluntarily accept these risks by participating
• You are solely responsible for ensuring that your participation is appropriate for your current physical condition
• KYMA28, its instructors, and Elevate Tht Ltd shall not be held liable for any injury, loss, or damage — whether physical, financial, or otherwise — arising from your participation in any class or use of studio equipment, except where such liability cannot be excluded by law
• You agree to follow all instructor guidance and studio protocols during sessions. Disregarding instructor guidance that results in injury shall be the sole responsibility of the client
• KYMA28 is not responsible for any personal belongings lost, stolen, or damaged on studio premises

Injury Protocol

In the event that you experience pain, discomfort, or injury during a class at KYMA28:

• Stop immediately and inform your instructor
• Do not continue exercising through pain — your instructor will always support you in modifying or stopping the session
• If medical attention is required, the studio will assist in contacting emergency services (112)
• You are encouraged to seek independent medical advice following any injury sustained during a class

KYMA28 does not currently have a dedicated first aid officer on site. Emergency procedures are in place and instructors are trained to respond calmly and assist in accessing emergency services when required.

Pregnancy Policy

KYMA28 does not offer classes for pregnant clients.

If you are pregnant, we ask that you do not attend classes at the studio for the duration of your pregnancy. We strongly recommend waiting until you have received explicit postpartum clearance from your doctor or midwife before returning to or joining KYMA28.

KYMA28 will not be held liable for any injury, complication, or harm arising from participation during pregnancy, whether disclosed or undisclosed at the time of attendance.

Right to Refuse

KYMA28 reserves the right to refuse or suspend access to any client at any time, at the studio's sole discretion, including but not limited to the following circumstances:

• A client's health condition presents a risk to themselves or others in the class
• A client has provided inaccurate or incomplete information on their health questionnaire
• A client's behaviour is disruptive, disrespectful, or unsafe
• A client is attending while pregnant
• A client's instructor, in their professional judgement, deems participation unsafe on a case-by-case basis

Where a client is refused access for health or safety reasons prior to the start of a class, the studio will use reasonable discretion in determining whether the class credit is reinstated.

Exceptional Circumstances

KYMA28 understands that life is unpredictable. In cases of genuine exceptional circumstances — such as a medical emergency or bereavement — the studio may, entirely at its sole discretion, consider exceptions to the standard cancellation, no-show, or expiry policies.

Exceptional circumstances are assessed individually and no exception creates a precedent or contractual obligation for the studio to offer the same exception in future. The studio's decision in all such cases is final.

Intellectual Property

All content associated with KYMA28 — including but not limited to the brand name, logo, class programmes, instructional content, website, and KYMA28 application — is the intellectual property of Elevate Tht Ltd and is protected under applicable copyright and trademark law.

You may not reproduce, distribute, or use any KYMA28 content for commercial purposes without prior written consent from Elevate Tht Ltd.

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from these Terms or your use of KYMA28 services shall be subject to the exclusive jurisdiction of the courts of Cyprus.

Nothing in these Terms affects your rights as a consumer under applicable European Union law.

If you have a complaint that cannot be resolved directly with the studio, you may also refer the matter to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to These Terms

KYMA28 reserves the right to update these Terms & Conditions at any time. When changes are made, the updated version will be published on our website and, where changes are significant, communicated to clients via the KYMA28 app or by email.

Your continued use of our services following any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
